Introduction

Please read this agreement carefully before using thesoftware and any manuals supplied to you ("the Software"). By using the Softwareyou agree to be bound by the terms of this agreement. If you do not agree to the terms ofthis agreement, promptly return the Software to your supplier.

Grant of Licence

Great Circle Software Limited grants you thenon-transferrable right to use one copy of the Software. It may be used on a singlededicated computer or single network workstation. You may not lend, rent, lease, sell,sublicense, assign, or otherwise transfer the Software for any purpose. You may notreverse engineer, decompile, disassemble, modify, or translate the Software. You areauthorised to make one copy of the Software solely for backup or archival purposes.

Limitation of Warranty and Liability

The Software is provided to you "as is" withoutwarranty of any kind. Great Circle Software Limited makes no warranty or representation,either express or implied, with respect to the Software, including, but not limited to,performance, merchantability, or fitness for a particular purpose, and assumes noresponsibility for the accuracy or application of or errors or omissions in the Software.The entire risk as to the results and performance of the Software is assumed by you. In noevent will Great Circle Software Limited be liable for direct, indirect, special,incidental, or consequential damages arising out of the use or inability to use theSoftware, even if advised of the possibility of such damages. Specifically, Great CircleSoftware Limited is not responsible for any costs including, but not limited to, thoseincurred as a result of lost profits or revenue, loss of use of the Software, loss of dataor equipment, the costs of recovering software or data or equipment, the cost ofsubstitute software or data, claims by third parties, or for other similar costs.

General

Great Circle Software Limited retains all rights. TheSoftware is owned by Great Circle Software Limited or its suppliers and is protected byNew Zealand copyright laws, international treaty provisions, and all other applicablenational laws. This Agreement shall be interpreted according to the laws of New Zealandand the parties agree to submit to the jurisdiction of the Courts of New Zealand.
